Capacity of persons
When an individual becomes partially or totally incapable to adequately care for themselves or for their property, it is necessary for the Court to determine which protective supervision is best suited for the individual – it can be an advisor or a Tutor. In instances where the individual has prepared a Mandate in Case of Incapacity, the Mandate must be recognized (homologated) by the Court for the mandatory to act on the individual's behalf and take care of their person or property.
